Terms and Conditions of Sale
The following Terms and Conditions of Sale apply to all products, merchandise, and services of whatever kind sold by The Pinball Gameroom, LLC (Seller), and by making any purchase from Seller’s website, the Purchaser hereby agrees to all terms below:
*Lifetime technical support via telephone and/or email.
*New products come with the manufacturer’s warranty, if any, and are subject to those terms or limitations. We do not offer any additional warranty on new products.
*Pre-owned products newer than 1990 come with a 90-day limited warranty on parts and labor. This warranty does not cover abuse or misuse on any item that is moved or repaired without authorization by The Pinball Gameroom, LLC.
*The following products are excluded from any warranty: pinball machines and arcades made prior to 1990, any item being used in a non-residential setting, any item used at a rental property and items noted “as is” in the product description. Coin-mechanisms are not included with purchase of machines and are not covered by warranty.
Product Set Up:
Some purchased items may require assembly or set up to ensure proper functionality or game play. If available, manuals or instructions are provided. We are not responsible for any damage to items due to improper setup. We may offer additional support or set up services depending on the options Purchaser selects at time of purchase. If support or setup is provided by The Pinball Gameroom, LLC or its authorized representatives, we assume no responsibility for damage to the item or the premises in which the item is being delivered. This includes but is not limited to damage to walls, doors, doorways, flooring, or any other surface, fixture, or furniture to which such damage might occur during delivery and setup. After delivery, support is offered via our website, by email at email@example.com, or by phone at (804)833-4967.
Seller makes no guarantee, expressed or implied, on the date or time of delivery of any products sold. Any estimates given are subject to change and are dependent on time and method of payment, product availability, and shipping company used. The delivery address provided by the Purchaser must be accessible by an 18-wheeler semi-truck. If the Purchaser provides a delivery address that is not accessible, any additional charges incurred by Seller to complete delivery must be paid by the Purchaser. The Purchaser is responsible for knowing the dimensions of the products being ordered and to ensure the delivery location is accessible. If a customer is unable to receive an item due to inaccessibility and it is returned, it will be considered a refusal to take delivery and will be subject to a partial refund according to the Returns and Cancellations Policy below.
It is Purchaser’s sole responsibility to inspect purchases immediately upon receipt for any possible damage and to follow the directions posted on the product packaging. Any damage must be noted on the shipper’s paperwork. If any damage is present, you must also immediately contact us to make a report. For purposes of this section, the term “damage” does not include small scratches, dings, or nicks that may result from product packaging and transit, or normal wear and tear from usage on pre-owned items. Such conditions do not warrant refusal of delivery or a product return.
Drop-Shipping and Consignment:
We reserve the right to furnish products, new and pre-owned, from third parties and have them delivered directly from these sources. Consignment sellers have the right to remain anonymous and silent parties to the sale. Any attempt by Purchaser to contact these sources will result in a transaction being deemed a final sale with no warranty (as-is).
Published or quoted prices are subject to change at any time without notice. Due to fluctuating market conditions, written price quotes expire after 24 hours from the date issued and are subject to change or termination with verbal or written notice to Purchaser during that period. All quotes and prices are subject to change due to new specifications, modifications, quantities, shipment methods or other terms and conditions which are not part of the original price quote.
Returns and Cancellations:
Purchasers wishing to cancel an order must do so in writing via email to firstname.lastname@example.org within 24 hours of purchase to receive a full refund. Cancellations and returns authorized by The Pinball Gameroom, LLC will be subject to restocking fees of up to 25% of the purchase price in addition to the cost of delivery and return shipping. Refusal to take delivery of products will result in a refund of 50% of the purchase price, minus applicable shipping and storage costs.
We have the right to collect from Purchasers all reasonable costs and expenses incurred in collection of any sums owed by Purchaser, and we shall not be obligated to make any further deliveries to Purchaser. Such reasonable costs and expenses shall include, but not be limited to, reasonable attorney’s fees.
AGREEMENT TO TERMS:
The Purchaser confirms that they have read, and agrees to, all terms, conditions and store policies listed in this document.
The Purchaser agrees that this agreement and all transactions hereunder, or any dispute or controversy arising out of, relating to, or in connection with any purchase, transaction, agreement, or its interpretation, with The Pinball Gameroom, LLC shall be governed by the laws of the Commonwealth of Virginia, and that venue will be proper in Chesterfield County, Virginia. In the event of Federal court litigation, all cases will be filed, conducted, and heard within the appropriate Federal Court in the Eastern District of Virginia.
